By downloading, accessing, purchasing, or using Bracket, you agree to these Terms of Use. If you do not agree, do not use the app or related services.
1. Acceptance and eligibility
You must be legally able to enter into these Terms. If you use Bracket on behalf of an organization, club, school, or business, you represent that you have authority to bind that entity to these Terms.
2. What Bracket provides
Bracket is software for creating and operating tournaments, including bracket generation, scoring, advancement, schedules, standings, competitor management, history, sharing, QR codes, and exports. Features may differ by app version, device, region, subscription status, and technical availability.
Bracket helps organize information but does not officiate matches, verify scores, determine legal eligibility, enforce sport rules, or replace the judgment of tournament organizers and officials.
3. License to use Bracket
Subject to these Terms and applicable App Store terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use Bracket for lawful purposes. You may not copy, reverse engineer, resell, rent, sublicense, exploit, or attempt to extract source code except where applicable law expressly permits it.
4. Your tournament content
You retain responsibility for the tournament information and other content you enter, import, share, or export through Bracket. You represent that you have the rights and permissions needed to use that content and that doing so does not violate law or another person’s rights.
You are responsible for reviewing scores, standings, bracket progression, participant information, and exports before relying on or publishing them. Keep appropriate backups or records for tournaments where data loss would cause significant harm.
5. Subscriptions and purchases
Some Bracket features may require a paid subscription or in-app purchase. Prices, billing period, trial terms if any, and included features are shown in the app before purchase. Payments are processed by Apple through the App Store.
Subscriptions may renew automatically unless cancelled through your Apple account at least as required by Apple’s applicable terms. You can manage or cancel subscriptions in your Apple account settings. Refund requests are handled according to Apple’s policies and applicable law.
We may change subscription offerings or prices prospectively. Changes to an active subscription take effect according to App Store rules and any notice required by law.
6. Acceptable use
You may not misuse Bracket or related services. In particular, you may not interfere with service operation, attempt unauthorized access, distribute malware, use the service to violate law or third-party rights, abuse support channels, or use automated means to overload hosted features.
7. Availability and changes
We may add, remove, modify, suspend, or discontinue features. We do not guarantee that every feature will always be available, error-free, compatible with every device, or suitable for a particular tournament. Hosted sharing or third-party services may experience outages outside our control.
8. Disclaimers
To the maximum extent permitted by law, Bracket is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded under consumer protection law.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, tournament opportunities, or data arising from your use of Bracket.
Where liability cannot be excluded, our aggregate liability for claims arising from Bracket will be limited to the greater of the amount you paid for Bracket during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.
10. Termination
You may stop using Bracket at any time. We may suspend access to hosted services or terminate rights under these Terms if you materially violate them, misuse the service, or if continued service would create legal or security risk. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms as Bracket evolves. Updated Terms will be posted here with a revised date. If a change materially affects your rights, additional notice may be provided where appropriate or required.
